Workplace bullying has no recourse under current law, yet it is prevalent and extremely damaging to everyone who experiences or witnesses it. Furthermore, workplace bullying creates is an aspect of a toxic work environment that limits decision-making, risk and opportunity analysis, and innovation. It has individual, organizational, and economic implications - all of which are negative and harm us all.

Why United Against Workplace Bullying Exists

Workplace bullying and abuse affect millions of workers across industries, yet legal protections remain limited, inconsistent, or ineffective. Many abusive behaviors are minimized, ignored, or dismissed—leaving victims without recourse and perpetrators without accountability.

United Against Workplace Bullying was created to:

  • Educate the public about workplace bullying laws and policy gaps

  • Advocate for stronger and clearer legislation

  • Support those impacted by workplace abuse

  • Mobilize collective action through petitions, campaigns, and public engagements

We believe no one should have to endure abuse to earn a living.

Understanding Workplace Bullying

What is Workplace Bullying?

Workplace abuse can take many forms. Is it often referred to as:

  • Bullying

  • Mobbing

  • Harassment

  • Retaliation

  • Discrimination

These behaviors may include intimidation, humiliation, sabotage, exclusion, false accusations, abuse of authority, or systemic targeting. When left unchecked, workplace bullying causes serious emotional, professional, and financial harm.

Our advocacy focuses on naming these behaviors clearly and pushing for laws that reflect the real experiences of worker.

Advocacy and Legislative Action

United Against Workplace Bullying closely monitors and supports legislation related to workplace abuse with a specific focus on California laws and institutions.

We provide:

  • Background information on proposed and existing laws

  • Updates on legislative developments

  • Tools to contact elected representatives

  • Templates and guidance for effective advocacy

Our goal is to ensure that laws protect workers and not abusers.

Current Petition

Remove "With Malice" from California's Definition of Abusive Conduct

We are advocating for the removal of the phrase "with malice" from the definition of abusive conduct in California Government Code Section 21950.1.

California needs to remove the words "with malice" from the definition of abusive conduct. These two words wipe out any real meaning in the abusive conduct law because "with malice" is a legal construct that requires publication of the harm by bullies.  It is not the common law meaning that we all understand that comes with this issue. We all know that workplace bullies do not publish their intentions to harm or defame you.  These two words obliterate the real definition of bullying, and render the definition in Gov. Code Sec. 12950.1 as meaningless.

This language creates an unnecessary and harmful barrier for victims seeking protection. Requiring proof of malice shifts the focus away from harmful behavior and onto intent—making accountability far more difficult.
